Welcome to SureYet. These Terms & Conditions (“Terms”) govern your use of sureyet.com (the “Site”) and any purchase you make from SureYet. “SureYet,” “we,” “us,” and “our” refer to as SureYet LLC, a Georgia business located at 3805 Creekview Dr NE, Marietta, Georgia 30068. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms incorporate by reference our Privacy Policy, Shipping Policy, and Return & Refund Policy. 

1. Eligibility

You must be at least 18 years old to create an account or place an order with SureYet. By using the Site, you confirm that you are at least 18 and have the legal capacity to agree to these Terms.

2. Our Products

SureYet offers gift and novelty merchandise designed for healthcare professionals, students, graduates, and others who share an interest in these communities.

• Novelty items only. Our products are decorative, gift, and novelty items. They are not medical devices or medical equipment, are not intended for clinical, diagnostic, or therapeutic use, and should not be used as such. Product designs that depict medical equipment are artistic illustrations only.
• No affiliation. Unless expressly stated, SureYet is not affiliated with, sponsored by, or endorsed by any professional association, credentialing body, school, university, hospital, or equipment manufacturer. References to professions, credentials, or equipment types are descriptive only.
• Product appearance. We make reasonable efforts to display products accurately. Colors, sizes, and details may vary slightly from photos due to screen settings and normal manufacturing variations.

3. Orders and Acceptance

Submitting an order is an offer to purchase and does not guarantee acceptance. We may accept, decline, cancel, or limit any order for any lawful reason, including product availability, pricing or listing errors, suspected fraud, payment authorization issues, incorrect product information, shipping restrictions, unusual order activity, or abuse of promotions or discount codes. If we cancel an order after payment has been processed, we will refund the amount paid to the original payment method.

4. Prices and Payment

• All prices are in U.S. dollars. Applicable sales tax and shipping charges are shown at checkout.
• Prices and availability may change at any time without notice. A price change does not affect orders already accepted, except in the case of an obvious pricing or listing error, in which case we may cancel the order and issue a full refund.
• Payments are processed by third-party payment processors. SureYet does not store complete credit or debit card numbers on its servers.
• By submitting payment information, you confirm that you are authorized to use the payment method.

5. Accounts

You are responsible for keeping your account login details confidential and for all activity under your account. Please notify us promptly at support@sureyet.com if you believe your account has been accessed without authorization. We may suspend or close accounts that violate these Terms.

6. Shipping

Shipping is governed by our Shipping Policy. We currently ship within the United States. Delivery dates and shipping estimates are estimates only and are not guaranteed. Risk of loss passes to you when the carrier delivers your order to the shipping address you provided.

7. Returns and Refunds

Returns, exchanges, and refunds are governed by our Return & Refund Policy.

8. Privacy

Our collection, use, and sharing of personal information, including through cookies, analytics, and advertising technologies, are described in our Privacy Policy.

9. Email and Text Messages

• If you subscribe, we may send you marketing emails. Every marketing email includes a link to unsubscribe. We will still send transactional emails related to your orders and account.
• Text messages (SMS). If you opt in to SureYet text messages, you agree to receive recurring automated marketing messages at the mobile number you provide. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help. Carriers are not liable for delayed or undelivered messages.

10. Reviews, Photos, and Other Content You Submit

If you submit reviews, photos, comments, or other content (“Your Content”), you confirm that it is accurate, that you own it or have permission to share it, and that it does not violate any law or third-party rights. You grant SureYet a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, display, and adapt Your Content (including your first name or username) on the Site, in marketing, and on social media. We may remove any content at our discretion. We do not pay for reviews and will not alter the meaning of reviews we publish.

11. Intellectual Property

All content on the Site, including product designs, illustrations, text, graphics, logos, photos, and the SureYet name, is owned by or licensed to SureYet and protected by intellectual property laws. You may not copy, reproduce, sell, or create derivative works from our content or product designs without our prior written permission.

12. Prohibited Uses

You agree not to: use the Site for any unlawful purpose; place fraudulent orders; interfere with the Site’s security or operation; use bots, scrapers, or automated tools to access the Site; impersonate any person; misuse or resell discount codes; or upload harmful code or content.

13. Resale and Commercial Use

Products are sold for personal use. We may cancel or limit orders that appear to be placed for resale or commercial purposes without our written agreement. For bulk, group, or school orders, contact support@sureyet.com.

14. Third-Party Services and Links

The Site may contain links to or features from third-party websites and services, such as payment processors, shipping carriers, and social media platforms. We are not responsible for their content, policies, or practices, and your use of them is subject to their own terms.

15. Promotions and Discount Codes

• Promotions and discount codes are valid only for the period, products, and conditions stated in the offer.
• Some codes are available only through specific channels (for example, an offer shown on Google, in an email, or on social media) and may be limited in time or quantity.
• Unless stated otherwise, only one discount code may be used per order, codes cannot be combined with other offers, cannot be redeemed for cash, and cannot be applied to past orders.
• We may modify or end any promotion at any time, and may cancel orders that involve misuse, abuse, or unauthorized sharing of codes without notice.

16. Website Availability

We aim to keep the Site available and accurate, but we do not guarantee that it will be uninterrupted, error-free, or free of harmful components. We may change, suspend, or discontinue any part of the Site at any time.

17. Disclaimer of Warranties

To the fullest extent permitted by law, the Site, its content, and our products are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except for any warranties that cannot be excluded under applicable law.

18. Limitation of Liability

To the fullest extent permitted by law, SureYet and its owners, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Site or our products. Our total liability for any claim relating to the Site or a product will not exceed the amount you paid for the product that is the subject of the claim. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

19. Indemnification

You agree to indemnify and hold harmless SureYet and its owners, employees, and service providers from any claims, liabilities, damages, losses, and reasonable expenses, including attorneys’ fees, arising from your violation of these Terms, your misuse of the Site or products, or Your Content.

20. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, severe weather, carrier or supplier delays, labor disputes, internet or utility outages, pandemics, or government actions.

21. Contact Us First: Informal Dispute Resolution

Most concerns can be resolved quickly by contacting us. Before filing any claim, you agree to first email support@sureyet.com with a description of the issue, your order number, and the resolution you are seeking, and to give us at least 30 days to try to resolve it informally.

22. Governing Law and Venue

These Terms and any dispute relating to the Site, your purchase, or our products are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. Any legal action or proceeding must be brought exclusively in the state or federal courts located in Cobb County, Georgia, and you consent to the personal jurisdiction of those courts. Either party may bring an individual claim in small claims court in Cobb County, Georgia, if it qualifies.

23. Severability

If any part of these Terms is found unenforceable, that part will be enforced to the maximum extent permitted, and the rest of these Terms will remain in effect.

24. No Waiver

Our failure to enforce any part of these Terms is not a waiver of our right to enforce it later.

25. Assignment

You may not transfer your rights under these Terms. We may assign our rights and obligations, including in connection with a merger, acquisition, or sale of our business.

26. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. The Terms in effect when you place an order apply to that order.

27. Entire Agreement

These Terms, together with the policies incorporated by reference, are the entire agreement between you and SureYet regarding the Site and your purchases.
